இந்திய சிறுவர் நீதிச் (பராமரிப்பும் பாதுகாப்பும்) சட்டம் 2000, எந்தக் குழந்தைகளுக்கு பராமரிப்பும், பாதுகாப்பும் தேவைப்படும் என்பதை கீழே கண்டவாறு வரையறை செய்துள்ளது. இருப்பிடம் மற்றும் பிழைத்திருக்கப் போதுமான வசதிகளற்ற நிலையிலுள்ள குழந்தை 2. அந்தக் குழந்தையின் பாதுகாவலரால் துன்புறுத்தப்படுவதற்கோ, அச்சுறுத்தப்படுவதற்கோ, வன்முறையைக் கையாண்டு காயப்படுத்தப்படுவதற்கோ, அந்தக் குழந்தை அவரால் புறக்கணிக்கப்படுவதற்கோ, அந்தக் குழந்தையை பாலியல் ரீதியாக தவறாக பயன்படுத்தப்படுவதற்கோ, அவரின் பாதுகாப்பிலிருக்கும் போது அக் குழந்தை கொல்லப்படலாம் என்று நம்புவதற்கு முகாந்திரம் இருக்கும் நிலை. 3. மன ரீதியாகவோ உடல் ரீதியாகவோ நோயுற்று அல்லது நோயின் இறுதி நிலையில் பராமரிப்பு இல்லாத நிலையிலுள்ள குழந்தை 4. பாதுகாவலர் இருப்பினும் பாதுகாவலரால் கட்டுப்படுத்தப்பட முடியாத நிலையிலுள்ள குழந்தை, 5. பாதுகாவலரால் கைவிடப்பட்ட, பாதுகாவலரால் பராமரிக்க விருப்பமற்ற, கைவிட்டு ஓடிப்போன பாதுகாவலரை தேடமுடியா நிலையிலுள்ள குழந்தைகள், 6. தவறான பாலுறவுக்காக அல்லது சட்ட விரோத செயல்களில் ஈடுபடுத்த அடைத்து வைக்கப்பட்ட நிலையிலுள்ள குழந்தை, 7. போதை மருந்து கடத்தலுக்குப் பயன்படுத்தப்படும் நிலையிலுள்ள குழந்தை, 8. மனச்சாட்சிக்கு விரோதமாக ஆயுதத் தேடலில் ஈடுபடுத்தப்படும் நிலையிலுள்ள குழந்தை, 9. ஆயுதக் கலவரம் (armed conflict), உள்நாட்டுக் கிளர்ச்சி (civil commotion), இயற்கைப் பேரழிவால் பாதிக்கப்பட்ட குழந்தைகளை பராமரிப்பும், பாதுகாப்பும் தேவைப்படும் குழந்தைகள் என்று இந்தியச் சட்டம் வரையறுத்துள்ளது.

1. Child without any home or settled place or abode and without any ostensible means of subsistence 2. Child who who has chances to be abused, to be injured, to be injured, to be neglected, likely to be killed by a person with whom the child resides (guardian) 3. Child who 'is mentally or physically challenged or ill children or children‘suffering from terminal diseases or incurable diseases having no one to support or look after, 4. Child with a parent or guardian is unfit or incapacitated to exercise control over the child,5. Child does not have parent and no one is willing to take care of or whose parents have abandoned him or who is missing and run away child and whose parents cannot be found after reasonable injury, 6. Child who is being or is likely to be grossly abused, tortured or exploited for the purpose of sexual abuse or illegal acts, 7. Child who is found vulnerable and is likely to be inducted into drug abuse or trafficking, 8. Child who is being or is likely to be abused for unconscionable gains. 9. Child who is victim of any armed conflict, civil commotion or natural calamity.
