குழந்தைகள் உள்ள தம்பதியினர் விவாகரத்தால் பிரிய நேரிடும்போது, குழந்தைகளின் நலனைக் கருத்தில் கொண்டு பெற்றோரில் யார் குழந்தையை நல்ல முறையில் பராமரித்து வளர்க்கமுடியும் என்று நீதிமன்றம் தீர்மானித்து அதன்படி பெற்றோரில் ஒருவரைப் பாதுகாப்பாளராக சட்டப்படி அனுமதி அளிப்பது. சிலநேரங்களில் குழந்தைகள் ஒவ்வொரு பெற்றோரிடமும் குறிப்பிட்ட கால பராமரிப்பில் இருக்கும்படியான கூட்டுப் பராமரிப்பிற்கும் நீதி மன்றம் அனுமதிப்பதுண்டு.

A legal determination in divorce cases specifying which parent or other guardian will be in charge of the children. This determination is based on what is considered to be in the best interests of the children. In some circumstances, joint custody is awarded so that responsibility is shared between both parents.
