விவாகரத்து பெரும் தம்பதியினர், தங்கள் வாழ்க்கையின் போது ஈட்டிய சொத்துக்களை சமமாகப் பங்கீடு செய்துகொள்வதற்கு வழிவகுக்கும் சட்டம். இச்சட்டம் அமெரிக்காவின் பல மாநிலங்களில் நடைமுறையில் உள்ள ஒன்று. சொத்துக்களை சமமாகப் பிரித்துக் கொள்ள இச்சட்டம் வழிவகுத்தாலும், விவாகரத்திற்குக் காரணமான, குற்றம் இழைத்த (கள்ளத் தொடர்பு போன்ற காரணங்கள்) தம்பதிகளில் ஒருவருக்கு நீதிமன்றம் சமமாகப் பிரித்துக் கொடுக்காது. இது சமமின்மையாகக் கருதப்பட்டாலும் நியாயமானதாகவே கருதப்படுகின்றது.

Distribution of real and personal property between interested parties in a way that is fair and just. In divorce cases, this law requires that all the property acquired during the marriage is divided equally or according to criteria that assure fairness. For example, if a wife works to put her husband through medical school and is then divorced, the degree may be considered marital property, and she may be entitled to part of his future earnings as a physician.
