implied consent

An agreement to participate expressed by gestures, signs, actions, or statements that are interpreted as agreement, or by nonresisting silence or inaction. This is often used as a defense in rape trials in which the defendant claims to have acted in the belief that the victim consented to the defendant's advances. See also informed consent.
