சம்பிரதாய விவாகரத்து வழக்கில், விவாகரத்து பெற விரும்பும் தம்பதியினர், ஒருவர்மீது ஒருவர் குற்றம் சுமத்தி, அந்தக் குற்றத்தை தகுந்த ஆதாரங்களுடன் நீதிமன்றத்தில் சமர்பித்தால்தான் விவாகரத்து பெறமுடியும். அப்படியில்லாமல் யார்மீதும் குற்றம் சாட்டாமல், தங்களுக்குள் மனமொப்பாமல் பிரிந்துவாழும் தம்பதியினர், பரஸ்பரம் பிரிந்து செல்ல விரும்பும்போது, நீதி மன்றங்கள் கொடுக்கும் விவாகரத்து.

Legal dissolution of a marriage that occurs without the necessity of declaring that one or the other spouse is guilty of marital misconduct. Before the enactment of no-fault divorce laws in several states, most marriages could be legally terminated only when one party proved that the other was guilty of behavior that was grounds for divorce. The most common basis for no-fault divorce is voluntary separation for a specified amount of time.
