ஆதரவற்றவர்களுக்கும், தங்களைத் தாங்களே கவனித்துக் கொள்ளமுடியாதவர்களுக்கும் அரசுதான் பாதுகாவலர் என்ற சட்டக் கோட்பாடு. இந்தக் கோட்பாட்டின்படியே குழந்தைப் பராமரிப்பு விசயங்களிலும், விவாகரத்து விசயங்களிலும் குழந்தைகள் எந்தப் பெற்றோருடன் இருக்க வேண்டுமென்றும், யாருடைய கவனிப்பில் வளர வேண்டுமென்றும் நீதிமன்றம் முடிவெடுக்கின்றது. இதையொட்டியே குழந்தைகள் தேசத்தின் / அரசின் சொத்தென்றும் அதைப் பராமரிக்கும் பொறுப்பு தற்காலிகமாக பெற்றோரிடம் விடப்பட்டிருக்கின்றதென்றும் கருதப்படுகிறது. இந்தக் கருத்தையொட்டியே மனித உரிமைப் பாதுகாப்பையும், சமூக நலத் திட்டங்களையும் அரசு செய்கிறது.

A legal doctrine that refers to the role of the state as guardian of people who are unable to care for them- selves. The concept is most often used in courts in deciding to intervene in family matters, such as custody of children, divorce disputes, and removal of children to foster care. Using this authority, the public at large is saying that a child is not the absolute property of a parent but a trust granted to a parent by the state.
