குழந்தைகளுக்குத் தேவையான பராமரிப்பு மற்றும் அவர்களின் அடிப்படை மனித உரிமைகளைப் பாதுகாப்பதற்கு அரசு பொறுப்பேற்க வேண்டுமென்று இந்திய அரசியல் நிர்ணயச் சட்டம் வலியுறுத்துவதாலும், ஐக்கிய நாடுகளின் பொதுச்சபை குழந்தைகளின் உரிமைகள் மீதான ஒப்பந்தத்தை முன்னெடுத்ததாலும், குழந்தைகளின் நலனில் அக்கறை கொண்ட அனைத்து அரசுகளும் ஒரேவிதமான தர நிலையைப் பின்பற்ற வேண்டுமென்றும், முடிந்த மட்டும் குழந்தைகளை நீதிமன்ற நடவடிக்கைகளுக்கு உட்படுத்தாது பாதிக்கப்பட்ட குழந்தைகளின் சமூக புனரமைப்பிற்கு உதவவேண்டும் என்று அந்த ஒப்பந்தம் வலியுறுத்துவதாலும், சிறுவர்கள் மற்றும் குழந்தைகளின் பராமரிப்பு மற்றும் பாதுகாப்பு சம்மந்தமான பல்வேறு சட்டங்களை ஒருங்கிணைத்து மேமடுத்தப்பட்ட சட்டம் இது. இச்சட்டம், சிறுவர்களையும், குழந்தைகளையும் தக்க முறையில் பாராமரித்து, பாதுகாத்து அவர்களின் வளர்ச்சிக்கு உதவும் வகையில் செயல்படவும், இச்சட்டத்தின் கீழ் அமைக்கப்பட்ட பல்வேறு நிறுவனங்களின் மூலம், குழந்தைகளின் மீதான வழக்குகளில் மனிதாபிமான அடிப்படையில் தீர்வு கண்டு குழந்தைகளுக்கு புனர்வாழ்வு அளிக்கவும் இச்சட்டம் வழிவகை செய்கிறது.

Indian Constitution has, in several provisions impose on the State a primary responsibility of ensuring that all the needs of children are met and that their basic human rights are fully protected besides General Assembly of the United Nations has adopted the Convention (1989) on the Rights of the Child and the Convention on the Rights of the Child has prescribed a set of standards to be adhered to by all State parties in securing the best interests of the child and the social reintegration of child victims, to the extent possible, without resorting to judicial proceedings. This act is to consolidate and amend the law relating to juveniles in conflict with law and children in need of care and protection, by providing for proper care, protection and treatment by catering to their development needs, and by adopting a child-friendly approach in the adjudication and disposition of matters in the best interest of children and for their ultimate rehabilitation through various institutions established under this enactment.
